These are the Terms and Conditions governing your use of the website www.urbansteelme.com (hereinafter referred to as “the Site”) and is effective upon registration on the Site.  Furthermore, www.urbansteelme.com may amend these Terms and Conditions at any time by posting the amended terms on the Site.  All amended terms shall immediately become effective once they are posted on the Site and any subsequent use of the Site shall be governed by such amended terms.  This agreement may not otherwise be amended except in writing signed by you and www.urbansteelme.com management. 
You are advised to regularly check for any amendments or updates to the terms and conditions contained in these Terms and Conditions.  If any clause of the Terms and Conditions shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of this agreement. 

You must read, agree with and accept all of the Terms and Conditions contained herein before you may become a member of www.urbansteelme.com.  We strongly recommend that you read this and other information on the Site as they may contain further terms and conditions that apply to you as a www.urbansteelme.com user. 

Article 1
Membership

Use of the Site is available only to people who can form legally binding contracts under United Arab Emirates law.  People who are “incompetent to contract”, including, but not limited to, minors, are not eligible to use the Site.  If you are a minor I.e. under the age of 18 years, you can not register as a member on the Site and, therefore, can not purchase any items from the Site.  If you wish to purchase an item from the Site, your legal guardian may register and purchase items on the Site.   The Site reserves the right to terminate your membership and refuse to provide you with access to the Site if it is discovered that you are under legal age.  Following this, the Site is not available to persons whose membership has been suspended or terminated.

You are responsible for maintaining the confidentiality of you account and password and for restricting access to your computer.  Moreover, you agree to accept responsibility for all activities that occur under your account or password.  You agree to:

- Provide true, accurate, current and complete information about yourself as prompted by the Site’s registration form, such information being the Registration Data.
- You must not include any of your contact details such as email address or mobile number in your username. 
- Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.  If you provide any information that is untrue, inaccurate, out of date or incomplete or if the Site has reasonable grounds to suspect that such information is untrue, inaccurate, out of date or incomplete, or not in accordance with the Terms and Conditions, the Site has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

While any person in accordance with the above  may register on the Site, the Site is directed solely at customers within Dubai, United Arab Emirates.  We do not represent that any item sold on the Site is appropriate for use or available in locations outside Dubai, United Arab Emirates.  If you choose to access the Site from locations outside Dubai, United Arab Emirates you are responsible for compliance with local laws and to the extent the laws apply. In these circumstances, the Site will not be responsible for any delays, damage, loss or hold ups regarding your purchase and no refund will be or monetary exchange will be granted should this situation arise. 

Article 2
Item Accuracy and Substitution

We accept items for orders subject to availability.  Should the item requested by you not be available during the time of purchase, you will be contact by a member of the Site’s staff and informed so, at which time you may select an alternative item to purchase.  If we are unable to contact you, we will process all remaining items as requested by you (for cases of multiple item purchase) with the exception of the item we were unable to supply. 

We have made every effort to display the colors, specifications and dimensions of the items on the Site as accurately as possible.  We cannot guarantee that any of these factors will exactly match the item you are purchasing.  Therefore, some minor differences in color, size, and overall appearance may exist between the picture of the item and the item itself.  The Site in no way claims that the pictures of the items represent the items themselves to the fullest extent.

Article 3
Payment

Membership on the Site is free.  The Site requires the amount of items purchased to presented in full at the time of Cash On Delivery purchasing methods.  A delivery charge is allotted at the time of purchase depending on the location the item should be delivered to or the amount of the total purchase order.  Said amount will stated clearly should it apply to your purchase order.

Payment for an item purchased on the Site is made on a Cash On Delivery basis only until otherwise stated.  Once the item has been delivered to you,  payment is then made by you to the delivery service on the spot.  The payment requested will not be different to the amount already disclosed to you on your electronic bill sent to you through the email address you have provided us. Two copies of your electronic bill will be delivered with the purchased items; one of which is to be signed and returned to the delivery service on the spot.

All registered users of the Site may communicate with us via emails, feedback forms available on the Site, and telephonically.  Additionally, a mobile telephone number has been published on the Site should any user require immediate assistance.  All emails and feedback forms will be sorted through and answered in a time frame of no longer than 48 hours.  Any member of the site may contact us for any and all queries regarding items they wish to purchase through any of the methods previously stated.  For this reason, users of the site are responsible for their purchase of items on the Site and any queries regarding said items must be cleared before you submit your online order.  Once you have requested an item from us, the item will be delivered to you and must be paid for in cash at the time of delivery. 

The Site holds each registered user contractually to the online order form that has been filled out and submitted therefore, registered users who submit orders for items from the Site and do not follow through with payment once said items have been delivered will have their account suspended until further notice from the Site’s management.  The Site’s management may contact the user through any means necessary to discuss the occurrence before reaching a decision on the future status of the user’s account.  Repeat offenders will have their membership terminated immediately.    

Article 4
Communication

When you visit the Site or send emails to us, you are communicating with us electronically.  Consequently, you consent to receive communications from us electronically.  We will communicate with you by email or by posting notices on the Site.  You agree that all agreements, notices, disclosures and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing.  The Site requires your consent during the registration process to occasionally send you promotional emails from the Site.  These emails announce new changes and features added to the Site to enhance you experience as well as any special promotions, newly added products, and any events that involve the Site.

Article 5
Use of the Site

You agree, undertake and confirm that your use of the Site shall be strictly governed by the following binding principles:

1.1. “Your Information” is defined as any public information you provide to us or other users of the Site in the registration or buying process, in the feedback area or through any email feature.  You are solely responsible for You Information, and we act as a passive conduit for your online distribution and publication of You Information.

1.2. Your Information shall not:
- be false, inaccurate or misleading
- be fraudulent
- infringe any third party’s rights of publicity or privacy
- be defamatory, libelous, unlawfully threatening or unlawfully harassing
- be obscene or contain any indecent representation of person
- contain any viruses, Trojan horses, worms, time bombs, cancel bots, Easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
- create liability for the Site or cause the Site to lose, in whole or in part, the services of our ISPs or other suppliers
- link directly or indirectly to or include descriptions of items, good or services that are prohibited    under the Terms and Conditions or any other applicable law being in force, but not limited to, the Local Drugs and Cosmetics laws
- link or include any outside material on the Site without written consent addressed to you from the Site and signed by www.urbansteelme.com management.

1.3. You represent and confirm that you shall be the sole and exclusive legal owner of the method you use to purchase items from the Site.  You shall have complete right, title and authority to purchase items from the Site.

1.4. In the event that any transaction or attempted transaction relating to any item is in violation of these Terms and Conditions or applicable laws comes to your knowledge, you shall take steps to inform www.urbansteelme.com of the same.  In the event that you do not, the Site shall not be responsible nor be liable for any financial restrictions or responsibilities including, but not limited to, full or partial refunds.

1.5. You shall not, either alone or in conjunction with other Users or non Users, manipulate or attempt to manipulate the prices as well as any other information of any item being sold on the Site.

1.6. You shall comply with all applicable Domestic and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including but not limited to Sales Tax, Income Tax, Service Tax, Central Excise, Custom Duty, Local Levies) regarding you use of our service and purchase of items.

Should clauses 1.1. - 1.7 not be applied by all Users at all times, and should any person cause intentional harm, manipulation or attempted manipulation of any content on the Site, the Site will take any legal action permissible under UAE law and any applicable law against that person if the Site deems it necessary to do so. 

Article 6
Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy.  We view protection of our users’ privacy as a very important principle.  We understand that you and Your Information are our most important assets.  We store and process Your Information on computers located in the United Arab Emirates that are protected by physical as well as technological security devices.  If you object to Your Information being transferred or used in this way, please do not use the Site.

Article 7
Breach of Terms and Conditions

Without limiting other remedies, the Site may limit you activity, immediately temporarily/indefinitely suspend or terminate you membership, and/or refuse to provide you with access to the Site if:
- You breach the Terms and Conditions or the documents it incorporates by reference
- The Site is unable to verify or authenticate any information you provide
- It is believed that your actions may cause legal liability for you, other Users or the Site
The Site may at any time at its sole discretion reinstate or suspend Users.  A User that has been indefinitely suspended may not register or attempt to register with the Site or use the Site in any manner whatsoever until such time that such User is reinstated by the Site.  Notwithstanding the forgoing, if you breach the Terms and Conditions or the documents it incorporates by reference, the Site reserves the right to recover any amounts due and owing by you to the Site and to take strict legal action including but not limited to a referral to the Cyber Crime Division and the initiating of criminal proceedings against you as per UAE law or the laws governing you country of residence. 

Article 8
Warranty and Liability

The Site and its suppliers provide the Site “as is” and without any warranty or condition, express, implied or statutory and specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.  You expressly agree that you use of the Site is at your sole risk. 

In no event shall the Site or its suppliers be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for monetary loss, goodwill, use, data or other intangible losses arising out of or in connection with the Site, its services or this agreement (however arising, including negligence).  The Site’s liability in any circumstance is limited to the amount of money paid by you to the Site.  The Site, its associates and technology partners make no representations or warranties about the accuracy, reliability, completeness, currentness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted.  Consequently, the Site assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Site.

Article 9
Indemnity

You agree to indemnify and hold the Site and our parent, subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of the User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. 

None of the provisions of the Terms and Conditions shall be deemed to constitute a partnership or agency between you and the Site and you shall have no authority to bind the Site in any manner whatsoever.

If any dispute arises between you and the Site during your use of the Site or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the Terms and Conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by the Site.  The place of arbitration shall be Dubai, UAE.  The local Arbitration & Conciliation laws shall govern the arbitration proceedings.

The entirety of these Terms and Conditions, as well as all written data provided by the Site, shall be governed and construed in accordance with the laws of the United Arab Emirates.
